The Statute of Limitations

One of the most important dates in the legal profession is the statute of limitations. The statute of limitations is a time limitation set by law that you have to file a lawsuit to pursue your claim. In other words, the statute of limitation is a deadline set by the law. If you try to file a lawsuit after the statute of limitations has ran, it will be too late.

To further complicate things, different states have different statutes of limitations. For example, the statute of limitations in Mississippi for a car accident (personal injury) claim is 3 years from the date of the accident. In Tennessee, however, the statute of limitations for a car accident is 1 year from the date of the accident. Missing these dates can bar your claim forever from the courts, with certain limited exceptions.

Furthermore, tort claims against the government have an even shorter statute of limitations in Mississippi. A tort claim against the government in Mississippi is 1 year. Also, before you can even file that lawsuit you have to send a notice of claim to the government entity 90 days before a lawsuit can be filed which in technically makes the statute of limitations shorter than it actually is. See the Mississippi Tort Claims Act.
